Two decrees published on June 30, 2017 in the official journal list the representative employers ‘and unions’ organizations for the next four years .

  • Representative employers’ organizations at national and interprofessional level:

– the Mouvement des entreprises de France (MEDEF);
– the Confederation of Small and Medium Enterprises (CPME);
– Union of local businesses (U2P).

At the interoccupational level, for the opposition to the extension of collective agreements in application of Article L. 2261-19 of the Labor Code , the weight of representative employers’ organizations is as follows :

– the Mouvement des entreprises de France (MEDEF): 70.82%;
– the Confederation of Small and Medium Enterprises (CPME): 24.97%;
– Union of local businesses (U2P): 4.21%.

Indeed, “in order to be extended, the branch agreement or the professional or interprofessional agreement, their amendments or annexes, must have been negotiated and concluded within the Joint Committee mentioned in Article L. 2232-9 .

The commission is composed of representatives of the organization’s trade union representative of employers and employees in the scope considered.

To be able to be extended, the branch agreement or the professional or inter-professional agreement, their addenda or annexes, must not have been the object of opposition, under the conditions provided for in Article L. 2231-8, d one or several organization s professional of recognized employers representative at the level in which member companies employ over 50% of all employees of companies adhering to the organization’s professional of recognized employers representative at this level “( Article L2261 -19 of the Labor Code ).

  • Representative trade union organizations at national and interprofessional level:

– the French Democratic Confederation of Labor (CFDT);
– the General Confederation of Labor (CGT);
– the General Confederation of Labor-Force Ouvrière (CGT-FO);
– the French Confederation of Management – General Confederation of Managers (CFE-CGC);
– the French Confederation of Christian Workers (CFTC).

At the inter – professional level, for the negotiation of collective agreements pursuant to Article L. 2232-2 of the Labor Code , the weight of the representative trade union organizations is as follows:

– the French Democratic Confederation of Labor (CFDT): 30.33%;
– the General Confederation of Labor (CGT): 28.56%;
– the General Confederation of Labor-Force Ouvrière (CGT-FO): 17.93%;
– the French Confederation of Management – General Confederation of Managers (CFE-CGC): 12.28%;
– the French Confederation of Christian Workers (CFTC): 10.90%.

In fact, ” the validity of an interprofessional agreement is subordinated to its signature by one or more representative trade union organizations having collected, in the elections taken into account for the purpose of measuring the hearing provided for in paragraph 3 of Article L. 2122-9 , at least 30% of the votes cast in favor of organizations recognized as representative at this level, irrespective of the number of voters, and the absence of opposition by one or more trade union organizations of employees representatives of the majority of the votes cast for the same organizations in the same elections, irrespective of the number of voters “( Article L2232-2 of the Labor Code ).
